| Pursuant to article 15 and other applicable provisions of the Federal Personal Data Protection Law, E.J. Krause de México, S.A. de C.V. and Krause Management Services de México, S. de R.L. de C.V. altogether, (the “Responsible”), located at Insurgentes Sur No.664, 4th Floor, Colonia Del Valle, Delegación Benito Juárez, Zip Code 03100, Mexico, Federal District, makes this Privacy Notice (the “Notice”) available to any individual person (the “Titleholder”) that delivers personal data to the Responsible.
The Responsible is committed to comply with the principles of legality, consent, information, quality, purpose, loyalty, equity and responsibility for the treatment and protection of the obtained personal data in order with the Federal Personal Data Protection Law.
The Responsible states that it has taken the necessary security measures to ensure the protection of personal data against damage, lost, alteration, destruction, or unauthorized treatment for the Titleholder. The personal data obtained by the Responsible include but is not limited to the following:
- Personal Information: name, address, phone number, e-mail, date of birth, nationality, civil status, tax number (Federal Taxpayer Registry), individual registration number (CURP).
- Tax Data: bank account number.
The personal data will be used by the Responsible for the purposes set out below:
- Provide services and products required by the Titleholder.
- Report changes in service or product provided by the Responsible.
- Report about new services or products related with the corporate purpose of the Responsible.
- Comply with obligations of the Responsible and the Titleholder.
- Evaluate the quality of the service provided by the Responsible.
- Conduct internal research on consumer habits.
- Conduct market research for marketers, advertisers and/or commercial research.
The consent of treatment of personal data is deemed to be granted in accordance with the terms and conditions described in the Notice if: the Titleholder not manifest any opposition, manifest interest in agreement or legal act with the Responsible and has an existing legal relationship with the Responsible.
The Responsible is not required to obtain the consent of the Titleholder when the treatment relates to data regarding personal financial and/or proprietary assets with the purpose to fulfill obligation pertaining from a legal relationship between the Titleholder and the Responsible, in accordance with the provisions in article 10 of the Federal Personal Data Protection Law.
The Titleholder is entitled to: (i) limit the use of personal data, (ii) access personal data that the Responsible has; (iii) get information regarding the treatment of them; (iv) request the correction in cases that the information is incorrect or incomplete; (v) request the cancellation or opposition when the information is not required in order to carry out the purposes specified in the Notice, was used in violation of the provisions of the Notice and/or the contractual relationship or service for which they were sent to the Responsible has been completed.
To exercise the rights indicated in the previous paragraph, the Titleholder should submit the respective application, under the following requirements: name and address of the Titleholder; document to accredit the identity of the Titleholder or the documents to accredit the representation of the same; a clear and precise description of the personal data regarding any of the mentioned rights in the last paragraph that the Titleholder seeks to exercise and any other element that facilitates the identification of personal data.
This request must be submitted in writing to the address of the Responsible or online to the following address unsubscribe@ejkrause.com.mx and/or privacidad@ejkrause.com.mx, once received it will be forwarded to the personal data department, which must reply within in a term of twenty days from the date of filing.
The Responsible states that the personal data of the Titleholder could be transferred for commercial or statistical purposes to suppliers, sponsors and/or any other national or foreign person with whom the Responsible has celebrated contracts or agreements; except in case of explicit opposition from the Titleholder. The third parties receiving personal information from the Titleholder shall observe the provisions of this Notice.
Information transfers to holding companies, subsidiaries or affiliates under the common control of the Responsible, or of a company or of any associated company of the Responsible may be made without the consent of the Titleholder. The Responsible reserves the right to include changes and/or updates in the Notice, on account of new legal provisions and new internal policies, such changes will be available at the facility and the website of the Responsible: www.ejkrause.com.mx; www.mexicowindpower.com.mx; www.expomanufactura.com.mx; www.thegreenexpo.com.mx; www.ebio.com.mx; and www.plastimagen.com.mx.
